Resolution Deeming Scope and Content of Draft Generic Environmental Impact Statement (DGEIS) for the East Quogue Area Study Adequate for the Purpose of Commencing Public Review; Set Public Hearing

WHEREAS, The 1999 Comprehensive Plan Update builds upon the 1970 Master Plan, both of which identify a number of significant land use, transportation, zoning, and capital improvement strategies.  The Update further refines strategies for the hamlet business centers, recognizing that each Hamlet presents different challenges and opportunities, and recommends that additional studies be conducted; and


WHEREAS, over 800 acres within the boundaries of East Quogue (“the Study Area”) have currently been identified as areas targeted for rapid development; and


WHEREAS, the Town Board has commissioned an analysis of potential land uses and impact thresholds within a 4,182 acre study area that evaluates land use alternatives in the context of potential cumulative environmental impacts is necessary in order to support sound planning, zoning and public investment in the East Quogue; and


WHEREAS, The Town Board has enacted a moratorium in the East Quogue Study Area by adopting Chapter 309 and extending said moratorium to expire on May 11, 2008; and


WHEREAS, by Resolution 2006-36 dated March 14, 2006, the Town Board of the Town of Southampton hired the consulting firm of Allee, King, Rosen and Fleming, Inc (AKRF) to prepare a Generic Environmental Impact Statement (GEIS) under the State Environmental Quality Review Act (SEQRA) to facilitate a comprehensive evaluation of all land use proposals for the area, with the assessment of all cumulative associated impacts, a consideration of alternatives, and presentation of mitigation measures; and

WHEREAS, on March 6, 2008, the Department of Land Management received the Draft Generic Environmental Impact Statement (DGEIS) from AKRF; and

WHEREAS, pursuant to 6 NYCRR § 617.9, as lead agency, the Town Board must determine whether to accept the Draft GEIS as adequate with respect to its scope and content for the purpose of commencing public review; and

WHEREAS, to assist the Town Board as Lead Agency, the Department of Land Management (DLM) staff reviewed the DGEIS for completeness of content and has determined that the document is adequate for public review and comment; and

NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Southampton hereby deems the scope and content of the Draft Generic Environmental Impact Statement (DGEIS) for the project known as East Quogue Area Study, which incorporates land use changes as per a Recommended Plan, adequate for public review; and

BE IT FURTHER RESOLVED, the Town Clerk is hereby directed to file A Notice of Completion of DGEIS/ Notice of Public Hearing on the East Quogue Study Area DGEIS for Publication in the Environmental Notice Bulletin (ENB) as prescribed in SEQRA (6 NYCRR) Section § 617.12; and

BE IT FURTHER RESOLVED, comments will be received and considered by the lead agency for no less than 30 calendar days from the first filing and circulation of the notice of completion, or no less than 10 calendar days following a public hearing, whichever is later; and

BE IT FURTHER RESOLVED, the Town Clerk is hereby directed that this resolution and a copy of the DGEIS be forwarded to all involved and interested agencies; and                                        

BE IT FURTHER RESOLVED, that the Town Clerk is hereby authorized to publish the following Notice of Public Hearing:




PLEASE TAKE NOTICE that a public hearing will be held by the Town Board of the Town of Southampton on April 8, 2008, at 6:00 p.m., at the Southampton Town Hall, 116 Hampton Road, Southampton, New York, to hear any and all persons with comments on the Draft Generic Environmental Impact Statement (DGEIS) for the East Quogue Study Area which includes a recommended land use plan being contemplated for adoption by the Town Board as an update to the Town’s 1999 Comprehensive Plan Update.


Copies of the Draft Generic Environmental Impact Statement which, as part of the analysis,

includes a recommended land use plan are on file in the Town Clerk’s Office Monday through

Friday, from 8:30 a.m. to 4:00 p.m., at the Quogue Library, and on the Southampton Town

Website at
