Acceptance of Findings Statement in Connection with the Final Generic Environmental Impact Statement (FGEIS) for the East Quogue Study Area and Adoption of the Recommended Plan as a Component of the Comprehensive Plan

Financial Impact



WHEREAS, The 1999 Comprehensive Plan Update builds upon the 1970 Master Plan, both of which identify a number of significant land use, transportation, zoning, and capital improvement strategies.  The Update further refines strategies for the hamlet business centers, recognizing that each Hamlet presents different challenges and opportunities, and recommends that additional studies be conducted; and


WHEREAS, over 800 acres within the boundaries of East Quogue (“the Study Area”) were identified as areas targeted for rapid development; and


WHEREAS, the Town Board commissioned an analysis of potential land uses and impact thresholds within a 4,182 acre study area that evaluated land use alternatives in the context of potential cumulative environmental impacts in order to support sound planning, zoning and public investment in the East Quogue; and


WHEREAS, by Resolution 2006-36 dated March 14, 2006, the Town Board of the Town of Southampton hired the consulting firm of Allee, King, Rosen and Fleming, Inc (AKRF) to prepare a Generic Environmental Impact Statement (GEIS) under the State Environmental Quality Review Act (SEQRA) to facilitate a comprehensive evaluation of all land use proposals for the area, with the assessment of all cumulative associated impacts, a consideration of alternatives, and presentation of mitigation measures; and


WHEREAS, on March 6, 2008, the Department of Land Management received the Draft Generic Environmental Impact Statement (DGEIS) from AKRF; and by Resolution No 2008-492 the Town Board accepted the DGEIS for public and agency review and circulated it accordingly; and


WHEREAS, public hearings were held on the DGEIS on April 8, April 22, May 13, and May 27, 2008.  The DGEIS comment period for submitting comments to the Town Clerk was held open until June 10, 2008; and


WHEREAS, in response to comments received, Allee, King, Rosen and Fleming, Inc (AKRF) prepared a Final GEIS in accordance with § 617.10 of 6 NYCRR (SEQRA) and having reviewed the FGEIS, the Town Board found that it adequately responded to comments and on August 25, 2008, by Resolution 2008-1288, found it to be complete, and the Town Clerk filed A Notice of Completion of Final Generic Environmental Impact Statement for Publication in the Environmental Notice Bulletin (ENB) as prescribed in SEQRA (6 NYCRR) Section § 617.12; and

WHEREAS, the Town Board as lead agency afforded the public and involved/interested agencies 30 days in which to consider the Final GEIS and provide any additional input that was necessary to incorporate into the findings; and


WHEREAS, after the requisite public consideration period, the Town Board  requested that a Findings Statement be prepared by AKRF, which summarizes the facts and conclusions of the Draft GEIS and Final GEIS, considers public and agency responses, weighs and balances the relevant environmental impacts with social, economic and other considerations, and provides a rationale for the Town Board’s decision; now


THEREFORE BE IT RESOLVED, that after review and consideration, the Town Board of the Town of Southampton hereby Accepts and Adopts the Findings Statement prepared on its behalf by AKRF, dated November 5, 2008 as amended November 14, 2008, pursuant to the State Environmental Quality Review Act and Chapter 157 of the Town Code; and


BE IT FURTHER RESOLVED, that the Recommended Plan that is assessed in the Draft GEIS and Final GEIS is hereby adopted as a component of the Comprehensive Plan; and 


BE IT FURTHER RESOLVED, as required by SEQRA and its implementing regulations, the Town Clerk is hereby directed to distribute and file copies of the Findings statement to the following involved and interested agencies:
