RESOLVED, that the Board of Trustees of the Freeholders and Commonalty of the Town of Southampton hereby authorizes the President and Secretary-Treasurer to sign the Permit of 4519 NOYAC LLC to demolish a preexisting wood dock; to construct a new dock for residential use that consists of a 4 ft. x 10 ft. ramp up; connecting to a 4 ft. x 43 ft. fixed pier catwalk measuring 4.5 ft. above grade over vegetation (per ACOE) and 26 inches above Mean High Water (MHW) over open water; connecting to a 4 ft. x 14 ft. ramp down; connecting to a 6 ft. x 20 ft. float; ramps and catwalk to be constructed with thru-flow decking to allow for light penetration; pilings, girders, ledger, and float to be constructed with untreated tropical hardwood; the pier length seaward of MHW measures 60 feet for the premises located at 4519 Noyack Road, Noyac, New York (SCTM No. 0900-24-3-25); and be it

WHEREAS, the Board of Trustees finds that the subject project is a Type II Action pursuant to 6 NYCRR Part 617 and no further environmental review is required under the State Environmental Quality Review Act; and

 

WHEREAS, two (2) Waterfowl Hunting Location Applications of BARRY A. CAIN, JR. were received in the Trustees’ Office on August 1, 2019 for two (2) new Waterfowl Hunting Locations (“WHL”) pursuant to Article V, Section 38 (B)(2), which two (2) proposed WHL(s) are located in the waters in front of 1018 Flanders Road, Flanders in Reeves Bay; (i) application requesting a floating duck blind; and (ii) a second application requesting a stake blind in the same location; and

 

WHEREAS, the Southampton Town Bay Constables, pursuant to Article V, Section 38 (C)(6), have reviewed the two (2) proposed WHL applications listed above and determined that the locations requested are at an unsafe distance from other blinds in the area and have recommended that they be DENIED; now therefore be it

 

RESOLVED, that pursuant to Article V (Waterfowl Hunting), Section 38(C)(6) of the Rules and Regulations for the Management and Products of Waters of the Town of Southampton, the Board of Trustees of the Freeholders and Commonalty of the Town of Southampton hereby DENIES the two (2) Waterfowl Hunting Location applications located in the waters in front of 1018 Flanders Road, Flanders in Reeves Bay found by BARRY A. CAIN, JR. and DENIES a Waterfowl Hunting Location Permit to BARRY A. CAIN, JR. to hunt said location.

WHEREAS, the Board of Trustees of the Freeholders and Commonalty of the Town of Southampton ("Trustees") are a corporate body politic and the owners of all of the waters of the Town of Southampton, including Mecox Bay pursuant to the Dongan Patent of 1686 and several acts of the New York State Legislature including Chapter 155 of the Laws of 1818, Chapter 283 of the Laws of 1831, Chapter 257 of the Laws of 1892; Chapter 872 of the Laws of 1896, Chapter 133 of the Laws of 1902, and Chapter 403 of the Laws of 1907; and

 

WHEREAS, for more than three hundred (300) years, the Trustees have periodically dredged the ephemeral inlet to Mecox Bay; and

 

WHEREAS, in response to the Trustees’ application for a ten (10) year maintenance dredging permit for Mecox Inlet, the New York State Department of Environmental Conservation (NYSDEC) required the preparation of a Management Plan for Mecox Bay (the “Plan”) as a condition of granting said permit; and

 

WHEREAS, in response to such requirement, the Board of Trustees were assisted by the Town of Southampton Environment Division in preparing such a Plan and with the SEQRA process; and

 

WHEREAS, the Trustees Division held several meetings with the NYSDEC, the US Fish and Wildlife Service (USFWS), and the US Army Corps of Engineers, as well as with local stakeholders, in order to receive feedback and to address any concerns during the preparation of the Plan; and

 

WHEREAS, the Draft Management Plan for Mecox Bay was released in September 2018; and

 

WHEREAS, the Board of Trustees held a public hearing on December 3, 2018 to receive public comments from any and all persons including inter alia, the Southampton Town Baymen’s Association; local farmers, and residential property owners in the vicinity of Mecox Bay; and

 

WHEREAS, the Board of Trustees determined that additional public hearings were needed, which additional hearings were held on December 17, 2018, January 8, 2019, February 11, 2019 and March 18, 2019; and

 

WHEREAS, the public hearing was closed on March 18, 2019; and

 

WHEREAS, Trustees determined that the adoption of the Plan is a Type I Action, pursuant to 6 NYCRR 617.4 (b)(10), and the Town’s Environment Division prepared an EAF Part I and send SEQRA coordination letters on March 21, 2019 to the Town of Southampton Town Board, New York State Department of Environmental Conservation, and U.S. Army Corps of Engineers; and

 

WHEREAS, the other involved agencies either had no interest in assuming Lead Agency Status or did not respond within the required statutory timeframes; and

 

WHEREAS, the Town’s Environment Division prepared the EAF Parts II and III, inclusive of a Negative Declaration (Determination of Non-Significance), for review by the Board of Trustees; and

 

WHEREAS, the Board of Trustees reviewed the EAF Parts II and III at their May 20, 2019 meeting and determined that the proposed periodic dredging of Mecox Inlet will not result in any significant environmental impact; and

 

WHEREAS, that the Board of Trustees of the Freeholders and Commonalty of the Town of Southampton assumed Lead Agency Status for the adoption of the Mecox Bay Management Plan and adopted a Negative Declaration (Determination of Non-Significance) pursuant to the State Environmental Quality Review Act at its meeting on May 20, 2019 pursuant to Trustees Resolution 2019-184; and

 

WHEREAS, a copy of the Negative Declaration was published in the May 29, 2019 Environmental Notice Bulletin; and

 

WHEREAS, the Trustees held a public hearing on the second draft of the Mecox Bay Management Plan dated August 2019 at their August 19, 2019 meeting; now therefore be it

 

RESOLVED, that the Trustees of the Freeholders and Commonalty of the Town of Southampton hereby adopt the Mecox Bay Management Plan dated August 2019; and be it

Recall and Amend Trustees Resolution No. 2019-298 to Accept Quitclaim Deed from John F. Cowell, III for a Portion of Old Sag Harbor Road, Bridgehampton, New York

 

WHEREAS, Trustees Resolution No. 2019-298 was adopted on September 4, 2019 to accept a quitclaim deed from John F. Cowell, III for an approximately 198 sq. ft. parcel known as SCTM# 900-36.00-2.00-017.000, which parcel is located within boundaries of the Trustee-owned road known as Old Sag Harbor Road in the hamlet of Bridgehampton, Town of Southampton; and

 

WHEREAS, Trustees Resolution No. 2019-298 directed that said quitclaim be recorded in the Suffolk County Clerk's Office and that a payment be made to the Suffolk County Comptroller's Office in the amount of $112.63 for taxes in arrears; and

 

WHEREAS, the Suffolk County Clerk’s Office has now advised the Trustees that there has been an increase in the amount of taxes in arrears for said parcel in the amount of $142.65;

now therefore be it

 

RESOLVED, that Trustees Resolution No. 2019-298 is hereby recalled and amended to reflect a total expenditure of $142.65; and be it

WHEREAS, the Town’s Environment Division also reviewed, considered, and referenced more than four (4) dozen previous studies on inlet dynamics; erosion and littoral drift; barrier beaches; and wildlife, inclusive of five (5) Mecox Bay specific studies, in order to develop the Plan; and

 

WHEREAS, the Draft Management Plan for Mecox Bay was released in September 2018; and

 

WHEREAS, the Board of Trustees held a public hearing on December 3, 2018 to receive public comments from any and all persons including inter alia, the Southampton Town Baymen’s Association; local farmers, and residential property owners in the vicinity of Mecox Bay; and

WHEREAS, no other involved agency had any interest in assuming Lead Agency Status for the issuance of a ten-year dredging maintenance permit for Mecox Bay; now, therefore, be it

 

RESOLVED, that the Board of Trustees hereby assumes Lead Agency Status for the application for the issuance of a ten-year maintenance dredging permit for Mecox Bay.                           

 

NOW, THEREFORE BE IT RESOLVED, that the Board of Trustees of the Freeholders and Commonalty of the Town of Southampton assumes Lead Agency Status for the adoption of the Mecox Bay Management Plan; and

 

BE IT FURTHER RESOLVED, hereby adopts a Negative Declaration (Determination of Non-Significance) pursuant to the State Environmental Quality Review Act; and

 

BE IT FURTHER RESOLVED, that the Town’s Environment Division is hereby directed to send a copy of the Negative Declaration to the New York State Department of Environmental Conservation, 50 Circle Road, Stony Brook, NY 11790-3409 and publish it in the next available Environmental Notice Bulletin.
