RESOLVED, that the Board of Trustees of the Freeholders and Commonalty of the Town of Southampton hereby authorizes the President and Secretary-Treasurer to sign the Permit of ALAN SOSNE for the reconstruction and reconfiguration of the existing dock structure; the new dock structures will consist of a 4’ X 55’ fixed elevated catwalk supported by sixteen (16) pilings, six (6”) inches in diameter including two (2) 4’ X 6’ pass and re-pass steps; a 3’ X 15’ hinged ramp; a 6’ X 20’ floating dock secured by four (4) pilings, eight (8”) inches in diameter; all hardware to be hot-dipped galvanized; all materials to be non-treated; all decking to be of an open grate design (i.e. ThruFlow Interlocking Panels or similar); the existing rip-rap along the seaward face of the seawall and concrete remains below the dock are to be removed and taken to an approved upland location for deposit/recycling and any portions of the seawall that exhibit any minor structural damage are to be repaired; a ten (10’) foot buffer to be established along the landward side of the seawall with native vegetation (i.e. American Beach Grass); upon removal of all rip rap and concrete remains, Spartina spp. to be planted in these areas (due to underwater soil conditions and wave energy, owner is not responsible for the success rate of these plantings) for the premises located at 5 Middle Pond Lane, Southampton, New York (SCTM No. 0900-272-2-1); and be it

1.              It is the recommendation of the Town Engineer that the Applicant submit a certified check to the Town Engineering Office in the amount of $19,000.00 (as requested by the Board of Trustees), made payable to the Board of Trustees, to be used by the Board of Trustees for the purpose of maintenance and improvements performed on Trustee owned Roads. A certified check must be submitted to the Board of Trustees prior to the issuance of a building permit.                                                                                                               

2.              Submission of all Trustee Road access and utility easements required by the Board of Trustees.

             

This determination is valid for a period of one (1) year and imposing the normal conditions of obtaining a building permit within one year of approval is recommended.

WHEREAS, the Board of Trustees finds that the subject project is a Type II Action pursuant to 6 NYCRR Part 617 and no further environmental review is required under the State Environmental Quality Review Act; now therefore be it

 

RESOLVED, that the Board of Trustees of the Freeholders and Commonalty of the Town of Southampton hereby authorizes the President and Secretary-Treasurer to RENEW THE PERMIT (SECOND) OF ARDK HOLDINGS II (No. 10771) issued July 14, 2014 as follows: work will be undertaken along the westernmost +/-400 linear feet of steel bulkhead spanning five (5) oceanfront properties for the restoration/re-nourishment of the dune using +/-2,000 cubic yards of clean compatible sand to cover the steel bulkhead which has been exposed due to recent storm erosion; re-vegetation of dune using American beach grass plugs 12 inches on center; and the replacement of the existing snow fencing for the premises located at 1299 Flying Point Road, Water Mill, New York (SCTM No. 0900-179-1-28); and be it

 

FURTHER RESOLVED, the following conditions shall apply:

 

Subject to and conditioned upon Permittee receiving any and all approvals required pursuant to the Town Code of the Town of Southampton.

Authorize Sale of Surplus Sand from Mecox Cut to Terry Contracting, Inc. To be Used in Connection with a Bulkhead Project at Flying Point Beach

WHEREAS, the Board of Trustees are the owners of land commonly known as the Mecox Cut located in Water Mill; and

 

WHEREAS, the New York State Department of Environmental Conservation (NYSDEC) issued an Emergency Authorization on December 13, 2016 to mechanically excavate a channel across the beach to establish a connection between Mecox Bay and the ocean; and

 

WHEREAS, the Board of Trustees recently caused the Mecox Cut to be dredged in order to raise salinity levels; and

 

WHEREAS, the excavated sand was stockpiled at the Mecox Cut; and

 

WHEREAS, Terry Contracting, Inc has contacted the Trustees and is interested in purchasing the stockpiled sand in order to cover some exposed steel bulkheads that are located just west of the Mecox Cut at Flying Point Beach in Watermill as required by a Town of Southampton Conservation Board covenant; and

 

WHEREAS, pursuant to the Emergency Authorization issued by the NYSDEC, if the stockpile area is not in a condition to support piping plover and least tern nesting and foraging by March 15, 2017, the Board of Trustees must grade the stockpile area to re-establish suitable nesting conditions by March 31, 2017; and

 

WHEREAS, the Board of Trustees recently contacted the NYSDEC and obtained consent to sell the sand for the bulkhead project in Watermill provided that the area is re-graded as per the conditions set forth in the Emergency Authorization; now therefore be it

 

RESOLVED, that the Board of Trustees hereby authorizes the President or the Secretary/Treasurer of the Board of Trustees to execute a contract with Terry Contracting for the sale of up to 2000 cubic yards of sand at $12.50 per cubic yard to be used for the purposes of covering the steel bulkheads located west of the Mecox Cut at Flying Point Beach in Water Mill; and be it

 

FURTHER RESOLVED, that pursuant to the contract, Terry Contracting will re-grade the area so that the conditions are suitable to support nesting and foraging of the piping plovers and least terns.

Award and Authorize President of the Trustees to Execute a Contract with Soule's Aquatics

WHEREAS, the Board of Trustees are always mindful of preserving, protecting and maintaining  the natural resources throughout the Town of Southampton for the benefit of all its residents;  and

 

WHEREAS, the Board of Trustees deem it necessary to stock Brown Trout and Rainbow Trout in the local lakes and ponds; and

 

WHEREAS, to execute this project the Board of Trustees must obtain a Fish Stocking permit from the New York State Department of Environmental Conservation at no charge; and

 

WHEREAS, on March 10, 2017, Contracts Compliance on behalf of the Board of Trustees secured quotes for stocking of the ponds with said quote due back on March 17, 2017; and

 

WHEREAS, Soule Aquatic's provided the only price for said services; now therefore, be it

 

RESOLVED, the Board of Trustees grant permission for the Secretary/Treasurer to sign the New York State Department of Environmental Conservation permit; and be it

 

FURTHER RESOLVED, that the Board of Trustees hereby authorize the President to enter into and execute a contract to be prepared by Contracts Compliance in an amount not to exceed $3,500.00 with Soule Aquatic's to purchase, deliver and stock the lakes and ponds selected within Southampton Town.
